 Under whose control are ‘babus’ in Delhi Government ?

This nagging question and continuing tussle between Arvind Kejriwal’s government with the Center is most likely to be answered on March 3rd next month when the CJI N V Ramana takes up the case while heading a three-judge bench.

On Tuesday the 15th of February 2022, the Supreme Court agreed to list the case in order to resolve long pending issue ‘as to who should control the Bureaucrats in Delhi.

Senior Advocate Abhishek Manu Singhvi sought hearing on controversial question behalf of the Delhi government.

Two Judges earlier had expressed opposite views on the matter necessitating the matter to be referred to a larger bench.

The legal issue involves the dispute between the Delhi Government and the Central Government regarding control over administrative services in the national capital.

It may be recalled that in February 2019, a two-Judge bench of the Supreme Court had delivered a split verdict on the question of powers of the Government of the National Capital Territory of Delhi (GNCTD) and the Union Government over services and referred the matter to a three-Judge bench.

Capital Delhi is a union territory administered by Central Government but having its own uniquely elected chief minister led local government.
